  1. This SHKP Club Forum is operated and owned by SHKP Club Limited ("Company"), a wholly owned subsidiary of Sun Hung Kai Properties Limited. The purpose of this SHKP Club Forum is to :
    1. facilitate communication between Sun Hung Kai Properties Limited, its subsidiaries and associated companies (collectively the "Group"), and customers, clients, friends of the Group and members and visitors of this SHKP Club Forum (customers, clients, friends, members and visitors collectively the "Customers");
    2. promote understanding between Customers and the Group, in particular, in respect of the information about SHKP malls; and
    3. provide a forum for discussion amongst Customers so that they can share their concern, knowledge and opinions concerning the activities, business, services and products in SHKP malls.

  2. Although the services of this SHKP Forum cover the whole Group, the Company itself shall be solely responsible for all matters, and/or all matters arising from the operation of this SHKP Forum and the provision of the services contemplated herein.Members are welcome to submit articles, enquiries, comments, opinions or other information (collectively "Articles") to this SHKP Club Forum via the Group's Internet web site. By submitting Articles to this SHKP Club Forum, Members unconditionally and irrevocably agree to be bound by the terms and conditions herein.

  3. Articles submitted by Members must not contain statements, pictures, data and information that :
    1. are libellous, defamatory, malicious, indecent, obscene, pornographic, discriminative, abusive, harassing or threatening
    2. violates the rights of others including but not limited to contractual rights, rights of invention and originality, copyrights and other intellectual property rights personal rights, rights of confidentiality, secrecy and privacy; or
    3. violates any law of any jurisdiction.

      Members shall not post, upload or transmit any Article that contains viruses, trojan horses, worms, time bombs, cancelbots, or any other harmful or deleterious programs to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunication equipment through this website.
      Member hereby warrants that he owns the content of the Articles submitted by him and the Articles do not violate the rights of any person.

      Members hereby agree to indemnify and keep the Company (or, as the case may be, the Group), its directors, staff and employees fully indemnified in respect of any penalty, claim, loss or demand for any breach or violation of any of the aforesaid.

  4. Member is responsible for maintaining the confidentiality of ?his password and account and are fully responsible for all activities that occur under his password or account. Member agrees to (a) immediately notify the Company of any unauthorized use of his password or account or any other breach of security, and (b) ensure that he exits from his account at the end of each session. The Company will not be responsible for any loss or damage arising from the failure to comply with thisclause.

  5. The Company has the absolute right to reject or refuse to publish any Article submitted to this SHKP Club Forum. In respect of those Articles chosen for publication, the Company has the unfettered right to edit, delete, re-arrange or re-phrase any Article or any part thereof at its absolute discretion without having to consult or obtain prior consent from the Customer concerned. Notwithstanding the aforesaid, neither the Company nor any member of the Group is responsible for the content of any Article or any imputation carried therein,which shall remain the sole responsibility of the Customer concerned
  6. An Article submitted to this SHKP Club Forum must be accompanied by the name, contact address and telephone numbers and such other information of the Customers concerned ("Personal Data") as the Company may require for identification and/or follow up purposes. All Personal Data shall be stored at and kept by the Company and the Company's Internet service provider (which is independent of the Group), and unless specifically requested in writing by the Customer to the contrary, all Personal Data may be retained and used by the Group, its professional advisers, insurers, or agents in relation to the Group's business, services and products or in any proceedings necessary and incidental hereto and thereto. Subject to the use aforesaid, all Personal Data shall be kept on a confidential basis. Articles submitted to this SHKP Club Forum whether published or not may be published or re-published by the Company in any other publications of the Group.? By using this SHKP Club Forum, Customers expressly grant to the Company a non-exclusive global licence to use, copy, reproduce and publish the Article or any part thereof submitted by the Customer in any publications issued or produced or to be issued or produced by the Company or the Group, and the Customer shall have no claim against the Company or the Group for any royalty, fee or charge whatsoever in connection with the use, copying, reproduction and publication of the Article or any part thereof.
  7. The Customers hereby acknowledge that the contents, views, expressions of opinion, advocacies, imputation or representations of or made in any Article are the contents, views, expressions of opinion, advocacies, imputation and representations of the Customer concerned and must not be construed or mistaken to be the contents, views, expressions of opinion, advocacies, imputation or representations of the Company or, as the case may be, the Group, irrespective of whether such Articles are published or not.
  8. Readers of any Article, including any comments, opinions and/or replies thereon and thereto made or published by the Company (or any member of the Group at the request of the Company), are hereby specifically warned to seek the opinion and/or advice from their own advisers in making any decision and should not rely on such Article or any part thereof. The Company (or, as the case may be, any member of the Group) hereby specifically disclaim any responsibility in respect of any reliance on any content, view, expression of opinion, advocacy, imputation or representation of or made in any Article and all liability in respect thereof are hereby expressly excluded. ?This disclaimer and exclusion of liability extends to the comments, feedback, opinions or replies to the Articles of the Company (or, as the case may be, any member of the Group).?     (g) facilitating communications between Members and the SHKP Club and any member of the Group and encouraging feed-back from Members on their needs and expectations of facilities, services and/or products of the SHKP Club, any member of the Group or any Relevant Person;
    (h) matching for whatever purpose (whether or not with a view to taking any adverse action against any applicant or Member) with other personal data relating to him/her in the possession or control of the SHKB Club and/or any other person;
    (i) to monitor use of this web site and to help its further development;
    (j) to collect data for identity verification and records and to maintain contact lists for correspondence;?
    (k) to operate internal control, resolve disputes, troubleshoot problems and enforce our terms of use ;

  17. No waiver by either party of any breach under these terms and conditions will amount to a waiver of any other breach.
  18. The Company reserves the right from time to time to change, suspend or terminate with immediate effect the provision of this SHKP Club Forum without prior notice.

These terms and conditions shall be construed and be governed by the laws of the Hong Kong Special Administrative Region, and the Customers hereby irrevocably submit to the non-exclusive jurisdiction of the Hong Kong Courts. These terms and conditions are also translated into Chinese language. In case of conflicts, the English version of these terms and conditions shall prevail.
  21. The Company reserves the right to amend the terms and conditions herein from time to time without prior notice.  Such changes shall be effective upon posting on this web site.?
